Waiver / liability release

SWEAT EQUITY - WAIVER AND RELEASE OF LIABILITY. PLEASE READ CAREFULLY - BY SIGNING, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING TERMS.

In consideration of being allowed to participate in any fitness activities, use of gym equipment,

training sessions, classes, events, or facilities (collectively, the "Activities") provided by Sweat Equity

(the "Gym"), I, the undersigned, hereby acknowledge and agree to the following:

1. Assumption of Risk

I understand and acknowledge that physical exercise and fitness activities, including but not limited

to strength training, cardiovascular exercises, martial arts, yoga, and use of any equipment, involve

inherent risks of injury, illness, or even death. I voluntarily assume all such risks, both known and

unknown, even if arising from the negligence of Sweat Equity or others.

I understand and accept that a gym environment contains equipment and activities that may pose risk to children, including the risk of injury.

I voluntarily assume all risks associated with my children at the facility.I understand that the gym does not provide childcare services or supervision.I agree to solely be responsible for supervising my children at all times. I will ensure they don't use or damage any equipment. I agree to indemnify and hold sweat equity harmless from any liability, damage or cost they may incur due to the presence or actions of my children at the facility.

Pets are welcomed, but must be leashed and kept out of the way of members and classes. Please clean any pet accidents, failure to do so will result in a $10 fee.

2. Medical Clearance

I affirm that I am in good physical condition and do not suffer from any condition or impairment that

would prevent or limit my participation in the Activities. I agree to consult with a qualified medical

professional before starting any fitness program if I have any concerns about my health.

3. Release and Waiver of Liability

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless Sweat

Equity, its owners, directors, employees, trainers, contractors, agents, and affiliates from any and all

claims, liabilities, demands, damages, causes of action, or legal actions of any kind arising out of or

related to my participation in the Activities or use of Sweat Equity's facilities or equipment.

4. IndemnificationI agree to indemnify and hold harmless Sweat Equity and its representatives from any and all liabilities or costs, including attorney's fees, arising from my negligent, reckless, or intentional acts or omissions during participation in any Activities.

5. Personal Belongings

I understand that Sweat Equity is not responsible for any lost, stolen, or damaged personal property

brought onto the premises.

6. Rules and Conduct

I agree to comply with all posted rules, safety guidelines, and instructions provided by Sweat Equity

staff. Sweat Equity reserves the right to revoke access at any time for behavior deemed unsafe,

disruptive, or inappropriate.

7. Media Release (Optional Clause)

I grant Sweat Equity permission to use my image, likeness, and voice in photos, videos, and other

media taken during activities for promotional purposes, unless I notify the Gym in writing otherwise.

8. Governing Law and Severability

This Waiver shall be governed by and construed under the laws of the state or country in which

Sweat Equity operates. If any portion is held invalid, the remainder shall remain in full force and

effect.

9. Payment

payment is due upon agreed membership, fee of $25/$50 will be applied after a three day grace period.

Membership Cancellation Policy

To cancel your membership, you must notify Sweat Equity Gym HTX directly. Informing your personal trainer does not constitute proper cancellation. It is your responsibility to contact the gym so we can remove your card from file and stop future charges. No refunds will be issued for charges incurred prior to official cancellation. All sales are final.
